Title
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the County to lease certain real estate located in White Oak Park to the United States Department of Transportation Federal Aviation Administration (the “FAA”).
Body
Whereas, the FAA wishes to extend and enter into a land lease agreement with the County of Allegheny, Department of Parks to lease approximately 0.90 acres of land of real estate located in White Oak Park, as more fully described in the attached property Supplemental Lease Agreement (the “Agreement”);
Whereas, the Agreement will grant the FAA, among other things, a right of way for ingress and egress establishing and maintaining a pole line or pole lines for extending electric power and or telecommunication lines to the premises and a right of way for subsurface power, communication and/or water lines to the premises;
Whereas, the term of this land lease agreement shall be October 1, 2009 through September 30, 2019;
Whereas, the County is of the belief that the extended land lease agreement will inure to the benefit of the citizens of the County by providing airport light beacons for the directional assistance for air traffic to the Allegheny County Airport and there will be no costs to the County and no revenues generated from this lease; and
Whereas, pursuant to Article IV, Section 2(k) of the Allegheny County Home Rule Charter, County Council is vested with the authority, by ordinance, to lease, convey, vacate or abandon, or permit the use of County Land, buildings or other real or personal property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization of a lease for the use of County Real Property.
The County Council of Allegheny County does hereby grant authority to lease that certain real estate to the FAA for the use of a certain parcel of property in White Oak Park for the placement of the non-directional airport beacons according to the terms and conditions as outlined in the Agreement.
SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

RE: NON-DIRECTIONAL BEACON

The U. S. Transportation, Federal Aviation Administration wishes to renew the contract with the Department of Parks for the placement of the Non-Directional Beacons located in White Oak Park. These beacons are placed in an area that does not interfere with the operation or activities of the Park. The Department of Aviation maintains the site and small structure.
The contract will be for a period of ten years, expiring September 30, 2019.
No costs to the County.
