Title: An Ordinance authorizing the County of Allegheny to convey a parcel of land in the Borough of Braddock, known as Block 237-G, Lot 65 (the “Parcel”) to the Josh Steel Company, Inc., a Pennsylvania Corporation.

An Ordinance authorizing the County of Allegheny to convey a parcel of land in the Borough of Braddock, known as Block 237-G, Lot 65 (the "Parcel") to the Josh Steel Company, Inc., a Pennsylvania Corporation.
 
      Whereas, the Parcel is currently owned by the Woodland Hills School District (the "School District"), the Borough of Braddock (the "Borough"), and the County of Allegheny (the "County"); and
 
      Whereas, the Parcel contains 18,000 SF of land located adjacent to property owned by Josh Steel Company; and
 
Whereas, the Borough advertised for bids on March 14, 2014; and
 
Whereas, Josh Steel Company, having an address of 46 Sixth Street, Braddock, PA 15104 has submitted a bid of $10,000 for the Parcel; and  
 
Whereas, the Borough  motioned to approve the sale of the parcel to Josh Steel Company on July 8, 2014, contingent on the approval of the  School District and the  County; and
 
Whereas, the School District approved the sale of the property to Josh Steel Company on June 18, 2014; and
 
      Whereas, the sale proceeds, after associated costs, would be split between the three taxing bodies on a pro-rated basis according to millage rates, which would be: the School District - 58%; the Borough - 30%; and the  County- 12%; and
 
 
      Whereas, Article IV Section 2(k) of the Home Rule Charter of Allegheny County and Article 701, Section 5-701.03 C. of the Administrative Code of Allegheny County vests County Council with the power and duty to convey by ordinance real property owned by the County.
 
 
 
 
 
      
The Council of the County of Allegheny hereby enacts as follows:
 
Section 1.      Incorporation of the Preamble.
 
      The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
 
Section 2.      Approval of Transfer of County Interest  in Block 237-G-65
 
A.      The County Council of Allegheny County does hereby approve the transfer of the interest held by the County in the Parcel located on Sixth Street in Braddock Borough known respectively as Block 237-G-65 to the Josh Steel Company for the consideration of $10,000 to be proportionally split between the three taxing bodies as aforesaid.
 
B.      The proper officers of the County of Allegheny are hereby authorized to execute any and all documents, including deeds, necessary to effectuate the conveyance of the County's interest in the Parcel.
 
Section 3.        Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
 
Section 4.        Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
