An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Administrative Code of Allegheny County, Article 905, entitled "Nonformal Procurement," §5-905.03, entitled "Procurement of professional services," and establishing a process to allow for the identification of contracts subject to review by the Professional Services Review Committee pursuant to §5-903.03 of the Administrative Code of Allegheny County in order to render the review process for such professional services contracts more efficient.

      Whereas, the Administrative Code of Allegheny County, §5-905.03 (A), states that the Professional Services Committee "will review and evaluate proposals for professional services for architects, engineers, financial consultants, legal services, and medical consulting"; and
 
       Whereas, while the Code expressly recognizes the Committee's involvement in reviewing such contracts, there is currently no process through which these contracts can be indentified independently of all County services contracts in the County's financial reports; and
 
      Whereas, it is the judgment of Council that establishing a process for identifying service contracts within the enumerated categories from the bulk of general service contracts would aid and expedite the review process required by the Code;
 
The Council of the County of Allegheny hereby enacts as follows:
 
Section 1.      Amendment of the Code.
 
The Administrative Code of Allegheny County, Article 905, entitled "Nonformal Procurement," §5-905.03, entitled "Procurement of professional services," is hereby amended as follows:
 
§5-905.03.  Procurement of professional services.
 
A.      To review and evaluate proposals received for professional services there is hereby created a Professional Services Review Committee. The Committee will review and evaluate proposals for professional services for architects, engineers, financial consultants, legal services, and medical consulting. The Committee shall be comprised of five members: the County Executive or his designee, the County Manager or his designee, two members appointed by the President of Council and one appointed by the Chief Executive with the consent of Council. An additional member will be designated by the County Official and/or the President Judge of the Court of Common Pleas, if the professional service contract being acted upon was requested by the respective office or the Court.
 
B.      In addition to compliance with any other terms, conditions and requirements set forth in a request for proposals, the Committee shall consider the following criteria:
 
(1)      Summary of costs;
 
(2)      Experience record;
 
(3)      Technical expertise;
 
(4)      Resources and capabilities;
 
(5)      Organization and management plan;
 
(6)      Disadvantaged business enterprise utilization; and
 
(7)      Such other criteria as the Committee shall deem prudent.
 
C.      After review and evaluation the Committee shall provide an agreed upon short list of at least three acceptable individuals or firms to either the County Executive, County Official, President Judge, or Council, for final selection. If there are three or less proposals received, all shall be submitted. The office which makes the final selection shall notify the Committee, and County Council, the Department of Budget and Finance and the Office of the Controller of the final selection.
 
 
D.      Upon receipt of notice of the final selection pursuant to Subsection C., the Committee, Department of Budget and Finance and the Office of the Controller shall specifically designate such contract as subject to review by the Committee in a fashion that allows for identification, tracking and reporting such contract values and terms separately from other County services contracts.
 
 
 
      Section 3.      Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
 
      Section 4.      Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
