An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing a revocable license to Columbia Gas of Pennsylvania, Inc. for a facility located in South Park on Stoltz Road.
WHEREAS, Columbia Gas of Pennsylvania, Inc. will construct an above ground regulator station with protective posts in the area of Bedford shelter close to the intersection of Library Road and Stoltz Road.
WHEREAS, Columbia Gas Company of Pennsylvania, Inc. will construct 20' x 20' regulator station area. Columbia Gas Company of Pennsylvania, Inc. will re-grade the property, install a fence with slats of the County's choice and plant mature plants to block the view from the entrance to the park. Columbia Gas Company of Pennsylvania, Inc. will also pay the County $25,000 for the revocable license.
WHEREAS, Columbia Gas of Pennsylvania, Inc. requests this upgrade in order to maintain safe and reliable pressure while serving their customers.
WHEREAS, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization to permit the use of County Real Property
County Council does hereby authorize the revocable license to Columbia Gas of Pennsylvania, Inc. in the vicinity of the intersection of Library Road and Stoltz Road in South Park. The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.
SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
