A Resolution of the Council of the County of Allegheny ratifying amendments to Allegheny County Health Department Rules and Regulations pursuant to Section 12011 of the Local Health Administration Law, 16 P.S. §12001 et seq.

                     Whereas, Allegheny County, pursuant to the Local Health Administration Law, 16 P.S. §12001 et seq., created the Allegheny County Health Department, and the Allegheny County Board of Health; and

 

                     Whereas, the Local Health Administration Law at Section 12011 provides for the Board of Health to adopt regulations and submit such regulations to Allegheny County for approval or rejection; and

 

                     Whereas, on May 4, 2005, Allegheny County Board of Health adopted the attached amendments to the Allegheny County Health Department Rules and Regulations, Article XV, Plumbing and Building Drainage, Section 106.7.12.4, "Plumber's License Fees"; and

 

                     Whereas, the Home Rule Charter of Allegheny County, Article IV Section 2(b), requires County Council to approve fees and service charges; and

 

Whereas, it is the desire of Council to ratify the Allegheny County Health Department regulation amendments as approved by the Board of Health.

 

The Council of the County of Allegheny hereby resolves as follows:

 

SECTION 1.                                          Incorporation of Preamble.

 

                     The provisions set forth in the preamble to this Resolution are incorporated by reference in their entirety herein.

 

SECTION 2.                                          Ratification of Regulations

 

                     Acting pursuant to the Local Health Administration Law and the Allegheny County Home Rule Charter, County Council hereby ratifies the amendments to the Allegheny County Health Department Rules and Regulations, Article XV, "Plumbing and Building Drainage", attached hereto as Exhibit "A".

                     

SECTION 3.                                          Severability.  If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

 

SECTION 4.                                          Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.

 

 

 

EXHIBIT "A"

 

 

AMENDMENT TO ARTICLE VI

 

AC 106.7.12.4 Plumber's License Fee Waiver for Plumbers Employed by the County of Allegheny

 

Any licensed Master or Journeyman Plumbers who hold active Plumber's Licenses, may upon full-time employment by the County of Allegheny, request that annual licensing fees be suspended during their tenure as County employees, so long as their work is limited to projects and jobs performed on behalf of the County.  Apprentice Plumbers employed by the County are not eligible for Plumber's License fee waivers.

 

All requests for Plumber's License waivers, along with proof of full-time County employment, must be made in writing to the Director within thirty (30) days of County employment.  All plumbing work performed outside the scope of official County duties must be performed under the authority of a Plumber's License not subject to the county employee fee waiver.  Upon termination from employment by the County for any reason, the suspension of fees will immediately cease, and former County plumbers must obtain a Plumber's License for that year or potion of a year in which work will be performed, for active licensed plumber status to continue.

 

 

 

SUMMARY OF LEGISLATION

 

                     This bill will ratify an amendment to the Allegheny County Health Department Rules and Regulations, Article XV, Plumbing and Building Drainage, which waives License Fees for Plumbers employed by Allegheny County doing work for Allegheny County.
