A Resolution of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the  formulation of policies governing the permitting of vendors conducting sales on the Roberto Clemente Bridge, as well as for permitting the closure of the Clemente Bridge for various events.

                                          WHEREAS, some of the greatest and most recognizable assets of Allegheny County and this region are the many bridges that span the rivers and smaller waterways of the area; and

 

WHEREAS, these bridges are nationally recognizable emblems of the City of Pittsburgh and Allegheny County and, in the case of the Roberto Clemente Bridge, have become inextricably intertwined with the Pittsburgh Pirates and PNC Park to the point that the bridge is closed to vehicle traffic when the Pirates play home games in order to allow for pedestrian traffoc, vendors' sales actvities, and other activities and events; and

 

                                          WHEREAS, the Clemente Bridge is owned by the County and, as a result, the County should carefully consider and have established polcies for the activities that may be undertaken on the bridge when it is closed to vehicle traffic; and

 

WHEREAS, Council also recognizes that an opportunity exists to create a new revenue stream through permitting the activities of vendors on the Clemente Bridge as well as the closure of he bridge itself; and

 

WHEREAS, Council also recognizes that an opportunity exists to provide events for County residents that are unique in both setting and character by using the Clemente Bridge as a venue for fairs, festivals, and other activities;

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                                          

 

The Chief Executive and such other entities within the County Administration as he or she sees fit are hereby authorized to formulate policies and procedures to be followed with regard to describing activities that may be undertaken on the Clemente Bridge when it is closed to vehicle traffic, as well as permitting those activities.  Such policies and procedures shall govern, but not be limited to, the following areas:  selection criteria for permissible activities and individuals or groups that will be granted permits to undertake those activities, selection criteria for permissible purposes for which the bridge may be closed to vehicle traffic and individuals or groups that will be granted permits for such closures, application requirements for permits, acceptable time frames for closing the bridge to vehicle traffic, and acceptable subjects and advertising materials to be allowable under the terms of such a permit.  Subject to the terms of the Home Rule Charter and other applicable authority, the Executive shall draft proposed legislation setting forth a fee structure for permits, enforcement provisions, and the entity or entities that will perform enforcement activities, and present such legislation to Council in a timely fashion for consideration and enactment.

 

 

SECTION 2.

 

The Chief Executive or such representative(s) as he or she chooses are hereby encouraged to investigate and pursue any opportunities for allowing concerts, fairs, festivals, farmers' markets, and such other public events that seem reasonable and prudent to allow to occur on the Clemente Bridge.  Funding for any such event provided to the public free of admission cost should be derived from the revenue generated by the permitting process implemented under Section 1 of this Ordinance.

 

 

SECTION 3.  Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

 

 

SECTION 4.                       Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
