Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of the donation of a horse to the County for use in the Allegheny County Police's Mounted Unit.

WHEREAS, Carol Jo Gaynor (Ms. Gaynor), who resides at 4284 Prosperity Pike, Prosperity, Pennsylvania, 15329, is the owner of a seventeen (17) year old Standard-bred pacer horse named “Crazy 4 Ever;” and
WHEREAS, Ms. Gaynor is willing to donate Crazy 4 Ever to the County for use as part of the Mounted Unit of the Allegheny County Police; and
WHEREAS, the County Police have determined that Crazy 4 Ever, contrary to his name, is a horse with a calm disposition and good ground manners who would make an excellent addition to the Mounted Unit; and
WHEREAS, Article IV, Section 2, Subsection j of the County’s Home Rule Charter requires that the Allegheny County Council approve an ordinance authorizing the acceptance of gifts or donations of real and personal property on behalf of the County.
WHEREAS, Allegheny County Council is of the considered opinion that the acceptance of donation of Crazy 4 Ever from Ms. Gaynor is in the best interest of the County.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. INCORPORATION OF THE PREAMBLE.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. ACCEPTANCE OF THE DONATION OF PERSONAL PROPERTY.
Acting pursuant to Article IV, Section 2, Subsection j of the County’s Home Rule Charter, Allegheny County Council hereby authorizes the acceptance of the donation of a seventeen (17) year old Standard-bred pacer horse named “Crazy 4 Ever” from Ms. Carol Jo Gaynor for use as part of the Allegheny County Police’s Mounted Unit.
SECTION 3. AUTHORIZATION OF OFFICERS TO ACT.
The appropriate County officers and officials are authorized to take any and all other such action to carry out the purposes of this Ordinance, including but not limited to the execution of any agreements to facilitate the acceptance of the donation of Crazy 4 Ever under such terms and conditions as the County Manager and such other appropriate County officers and officials deem necessary and prudent.
SECTION 4. SEVERABILITY.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 5. REPEALER.
Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
SECTION 6. Effective Date.
This Ordinance shall become effective immediately.
