An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, directing the Department of Administrative Services to make information about Sexually Violent Predators, required to register under Megan's Law, available to the public through the Allegheny County Website.

WHEREAS, “Megan's Law”, 42 Pa.C.S.A. §9791 et. seq., provides that individuals designated as sexual offenders or sexually violent predators must register with police; and that the whereabouts of sexually violent predators be used so that the communities in which they live may be aware of the potential dangers associated with them; and 

 

WHEREAS, the name; home address or addresses; the offense for which the person was convicted; a statement that the individual has been determined by court order to be a sexually violent predator, which determination has or has not been terminated as of a date certain; and a photograph of each person registered as a sexually violent predator living within the state is available to the public; and

 

WHEREAS, it is the constant goal of Allegheny County Council to make the County as safe as possible for its residents; and

                     

                     WHEREAS, the Allegheny County Website is a commonly used source of information for our residents; and

 

                     WHEREAS, the Allegheny County District Attorney and the Allegheny County Police have offered to assist the Department of Administrative Services in providing information about registered sexually violent predators within the state.

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.                     Directive to Make Information on Registered Sexually Violent Predators Living within the State Available through the Allegheny County Website

 

The Department of Administrative Services shall direct the Department of Computer Services to place the following on the Allegheny County web site:

 

A.                     An icon alerting visitors of the opportunity to access information about sexually violent predators who are registered with the Pennsylvania State Police; and

 

B.                     A link to the Pennsylvania State Police's web page containing the listing of sexually violent predators; and

 

C.                     A link to the Pennsylvania State Police's web page containing information on Megan's Law; and

 

D.                     As an introduction the links required above, a section of text discussing sexually violent predators, Megan's Law or related public safety issues.

 

Section 2.                     Directive for the Department of Administrative Services to Seek Input from the Allegheny County District Attorney and Allegheny County Police

 

Prior to posting any icon or link discussed in Section 1, above, on the Allegheny County website, the Department of Administrative Services shall confer with the  Allegheny County District Attorney and the Allegheny County Police to provide each with the opportunity to submit information that they deem important for the safety of Allegheny County Residents.  The Department of Administrative Services shall post the information provided by the District Attorney and/or County Police on the website as an introduction to the link to the Pennsylvania State Police website.

 

The introductory text shall be updated by the Department of Administrative Services at the request of the Allegheny County District Attorney and/or the Allegheny County Police when the amendment, addition or deletion of information is sought.

 

SECTION 3.                                          If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION 4.                                          Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
