An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania authorizing the conveyance of four (4) County Police horses to private individuals.

Whereas, Section 701.05 (C) of the Administrative Code provides that the County may dispose of any County-owned personal property in a manner approved by the County Manager provided that the personal property has been determined by the County's Controller to have a nominal value; and
Whereas, the County is the owner of four (4) horses that have been used by the Allegheny County Police Department; and
Whereas, the aforementioned County Police horses have reached an age when and/or have physical conditions where they should be retired from active duty; and
Whereas, the Superintendent of the Allegheny County Police has requested that the ownership of these animals be transferred to private individuals who have committed to caring for the horses in their “retirement”; and
Whereas, the Controller has determined that the horses have only nominal value because of their advanced age and/or physical condition; and
Whereas, Article IV, Section 2 (k) of the Allegheny County Home Rule Charter provides that County Council may authorize, by ordinance, the conveyance of County-owned personal property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of Preamble
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization to Transfer Ownership of County Police Horses
A. Pursuant to Section 701.05 of the County Administrative Code County Council does hereby authorize the Superintendent of Allegheny County Police, or his designee, to transfer the legal ownership of four (4) County Police horses as follows:

B. The County Manager or his designee is hereby authorized to take any and all other action deemed necessary and convenient to carry out the purposes of this Ordinance.
SECTION 3. Conditions of Transfer
The transfer of legal ownership of the horses to the new owners named in Section 2 is subject to the following conditions:
A. The new owners shall provide proper care, including without limitation veterinary care, grooming and shelter for the animals.
B. The animals shall not be used for any law enforcement or revenue-producing purposes.
C. The animals may not be re-sold.
SECTION 4. Severability If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 5. Repealer Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
