A Resolution of the County of Allegheny amending the 2009 Capital Budget for Allegheny County.

Whereas, the County has adopted a Capital Budget for the fiscal year beginning
January 1, 2009 and ending December 31, 2009; and
Whereas, at the request of the County's Department of Budget and Finance, County
Council desires to amend the 2009 Capital Budget as set forth in Attachment “A;” and
Whereas, the 2009 Capital Budget will remain in balance if the amendments set forth in Attachment “A” are approved.
The Council of the County of Allegheny hereby resolves as follows:
SECTION 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.
SECTION 2. Approval of Capital Budget Amendment.
The County Council of Allegheny County approves the amendment to the Allegheny County 2009 Capital Budget as set forth in Attachment “A” hereto by establishing an appropriation for a new project entitled “Browns Hill Road Improvements” in the amount of $3,000,000 and an appropriation for a new project entitled “River Road Relocation” in the amount of $2,500,000. Funding for the projects will be provided by the Pennsylvania Department of Transportation and the Pennsylvania Industrial Development Authority, respectively, as set forth in Attachment “A”. No increase in County bond funds will be required.
SECTION 3. Line Item Detail Amendment.
The line item detail of the appropriations previously approved by Council shall be amended as reflected in Attachment “A” hereto, the provisions of which are incorporated herein by reference.
SECTION 4. Severability. If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
SECTION 5. Repealer. Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
SUMMARY OF LEGISLATION
The attached legislation will amend the 2009 Capital Budget by providing additional funds for two new projects - Browns Hill Road Improvements and River Road Relocation. The Department of Public Works will widen and improve the intersections on Browns Hill Road and create an additional intersection which will connect to a new City development. The project is sponsored by the City's Urban Redevelopment Authority (URA) and will be 100% reimbursed by the Pennsylvania Department of Transportation at a total cost of $3,000,000. Because this is a County road, the County is responsible for the project even though the URA is the sponsor. In addition, the Department of Public Works will relocate River Road and Milelock Lane in Brackenridge in cooperation with the Department of Economic Development in order to accommodate the expansion of Allegheny Ludlum's plant at that location. Total cost of the project is $2,500,000, to be reimbursed by the Pennsylvania Industrial Development Authority. If this amendment is approved, the 2009 Capital Budget will remain in balance with no increase in County bond funds required.
