TITLE
A Resolution of the County of Allegheny amending the 2007 Capital Budget for Allegheny County.

BODY
Whereas, the County has adopted a Capital Budget for the fiscal year beginning January 1, 2007 and ending December 31, 2007; and

Whereas, at the request of the County's Department of Budget and Finance, County Council desires to amend the 2007 Capital Budget as set forth in Attachment “A”; and

Whereas, the 2007 Capital Budget will remain in balance if the amendments set forth in Attachment “A” are approved.


The Council of the County of Allegheny hereby resolves as follows:

Section 1. Incorporation of Preamble.

The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.

Section 2. Approval of Capital Budget Amendment.

The County Council of Allegheny County approves the amendment to the Allegheny County 2007 Capital Budget as set forth in Attachment “A” hereto by establishing a project entitled “Duquesne and McKeesport Fly-over Ramps” with an appropriation of $24,000,000. Funding for the project will come from the Commonwealth of Pennsylvania Department of Transportation as set forth in Attachment “A”. No County bond funds will be required.

Section 3. Line Item Detail Amendment.

The line item detail of the appropriations previously approved by Council shall be amended as reflected in Attachment “A” hereto, the provisions of which are incorporated herein by reference.



Section 4. Severability. If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

Section 5. Repealer. Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.












SUMMARY OF LEGISLATION

The attached legislation will amend the 2007 Capital Budget. The County will undertake construction of two fly-over ramps at the City Center of Duquesne and the Industrial Center of McKeesport at a total cost of $24 million in order to improve vehicular access to the sites and help return them to viable economic use. Funding for the project will be $24 million in reimbursements from the Commonwealth of Pennsylvania Department of Transportation. No County bond funds will be required.

The Scope of Work to be performed by the Department of Public Works is as follows:

Duquesne Flyover Ramp (Design work completed):

1. Construction of ramps, roadway, end walls, abutments and bridge structure to connect Route 837 to North Linden Avenue crossing over railroad tracks in the City of Duquesne. The project will provide additional access to the riverfront development site.

2. A heavy highway contractor will be engaged by the Department of Public Works to perform the construction work. Public Works will bid and award the construction work in accordance with the Public Works Contracting Manual, PennDot procedures and Federal Highway Administration requirements.

3. A construction management firm has been engaged to assist with the administration of the construction work. Public Works engaged this firm in accordance with the Public Works Guidelines for Consultant Services and PennDot and Federal Highway Administration requirements.

McKeesport Flyover Ramp (Design work pending):

1. Design of ramps, roadway, endwalls, abutments and bridge structure to connect Lysle Boulevard to Industry Drive, crossing over railroad tracks in the City of McKeesport. The project will provide additional access to the riverfront development site.

2. An engineering design firm will be engaged to perform the design work. Public Works will engage this engineering design firm in accordance with the Public Works Guidelines for Consultant Services and PennDot and Federal Highway Administration requirements.

3. A heavy highway contractor will be engaged by the Department of Public Works to perform the construction work. Public Works will bid and award the construction work in accordance with the Public Works Contracting Manual, PennDot procedures and Federal Highway Administration requirements.

4. A construction management firm has been engaged to assist with the administration of the construction work. Public Works engaged this firm in accordance with the Public Works Guidelines for Consultant Services and PennDot and Federal Highway Administration requirements.
