An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, granting permission for the County of Allegheny to purchase from the Buncher Company the building that houses the offices of the County Medical Examiner (Hereinafter, “the ME’s Building”).

Whereas, the County of Allegheny (hereinafter referred to as “County”) is currently in a 20-year lease of the ME’s Building with the Buncher Company, a for-profit corporation duly existing under the laws of the Commonwealth of Pennsylvania; and
Whereas, the County, pursuant to a Rider to the Amended Lease Agreement of the ME’s Building holds an option to purchase that portion of Penn Liberty Plaza II that comprises the ME’s Building; and
Whereas, The County commissioned an appraisal of the ME’s Building, which disclosed that the value of the ME’s building far exceeded the option price contained in the Rider to the Amended Lease Agreement; and
Whereas, The County has paid for significant improvements and fixtures at the ME’s building during the course of the 20-year lease; and
Whereas, the County, exercised the said option to purchase that portion of Penn Liberty Plaza II that comprises the ME’s Building; and
Whereas, after due consideration by the County Manager, the County Law Department and the County Office of Management & Budget it was concluded that exercising the option to purchase is a sound financial decision that will result in significant cost avoidances, long-term cost savings to the County, and plenary control of the building.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization to enter into the lease agreement.
The County of Allegheny is authorized to purchase the Medical Examiner’s Building on those terms and conditions negotiated by the County Manager.
SECTION 3. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
SECTION 4. Repealer.
Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
SECTION 5. Effective Date.
This Ordinance shall become effective immediately upon its approval.
