A Resolution closing out the Department of Conservation and Natural Resources Community Conservation Partnerships Grant Project (BRC-TAG-10-40), used in part to fund the Allegheny County Comprehensive Plan and, specifically, to fund the Parks, Greenways and Open Space Element of the Plan.

Whereas, Allegheny County Department of Economic Development has prepared a Comprehensive Recreation, Parks, and Open Space Plan as part of the County Comprehensive Plan for the Allegheny County area; and
Whereas, the purpose of the Plan is to guide future recreation, park, open space, and conservation acquisition, development, operations, and maintenance; and
Whereas, the Plan was financed in part by a Community Conservation Partnerships Program grant under the administration of the Pennsylvania Department of Conservation and Natural Resources, Bureau of Recreation and Conservation, under contract number
BRC-TAG-10-40; and
Whereas, the Pennsylvania Department of Conservation and Natural Resources requires that the grant recipient pass a resolution closing out the grant upon the completion of the grant terms.
The Council of the County of Allegheny hereby resolves as follows:
Section 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.
Section 2. Approval of Contract Close Out.
For the purposes set forth in the Recitals, and subject to the limitations set forth in the last Recital stated above, the County of Allegheny, Pennsylvania, acting by and through its County Council, hereby declares that:
(a) The project was completed in accordance with the Grant Agreement.
(b) All project expenditures have been made and were in accordance with the Grant Agreement.
(c) The Plan and related materials are acceptable to the County of Allegheny.
(d) The Plan and related materials will be used to guide future recreation, park, open space and conservation acquisition, development, operations, and maintenance.
The appropriate public officials of the County, in cooperation with the Pennsylvania Department of Conservation and Natural Resources, are hereby directed to take such additional action as is necessary to effectuate the closeout.
Section 3. Severability. If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
Section 4. Repealer. Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.

DEPARTMENT OF CONSERVATION AND NATURAL RESOURCES GRANT
SUBMITTED FOR COUNCIL MEETING JUNE 16, 2009
On behalf of County Executive Dan Onorato, the Department of Economic Development is in the process of closing out the Department of Conservation and Natural Resources (DCNR) Grant (Community Conservation Partnerships Grant Project BRC-TAG-10-40) that was used in part to fund the Allegheny County Comprehensive Plan, and specifically, to fund the Parks, Greenways and Open Space Element of the Plan.
It is the policy of DCNR to require a resolution passed and signed by the governing body in order to close out the grant. DCNR holds back 10% of the grant funds until it receives a copy of the product(s) for which the grant paid (hard and electronic copies of the Comprehensive Plan and new GIS layers), a final payment request form, a letter from the consultant stating that the contract has been paid in full, and a resolution stating the following:
The project was completed in accordance with the Grant Agreement.
All project expenditures have been made and were in accordance with the Grant Agreement.
The Plan and related materials are acceptable to the County of Allegheny.
The Plan and related materials will be used to guide future recreation, park, open space, and conservation acquisition, development, operations, and maintenance.
The grant amount is $300,000; therefore $30,000 is being held back until all close out requirements are met.
