Whereas, the County of Allegheny, Parks Department, has permitted Mon Yough Community Services, Inc., to use this facility in White Oak Park for many years; and.

Whereas, Mon Yough Community Services, Inc. wishes to continue using this property of the County without interruption until December 31, 2008; and

Whereas, the County deems it to be in the public interest to grant continued use of this property of the County site to Mon Yough Community Services, Inc.; and

Whereas, by permitting this use, the County enjoys improved public relations; and

Whereas, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble.

The provision set forth in the preamble to this Ordinance are incorporated by reference in their entirely herein.

SECTION 2. Authorization of a Lease for the Use of County Real Property

Allegheny County Council hereby approves the continuation of a lease to Mon Yough Community Services, Inc. for the continuation of the programs offered at the White Oak Park known as ANGORA GARDENS for the benefit of many special need adults.

Council hereby acknowledges the contract for the period on-going and continuing through December 31, 2008, subject to the terms and conditions as more fully outlined in the written lease to be negotiated.

The proper officers of the County are hereby authorized to negotiate and execute any and all documents necessary to effectuate the lease of the property.

SECTION 9. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

SECTION 10. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
