TITLE

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania authorizing acceptance by the County of Allegheny of a donation from Crawford County Solid Waste Authority of ten (10) V-Quip Recycling to be used for municipal recycling purposes during the containers' useful life  

BODY                     

Whereas, Crawford County Solid Waste Authority, seeks to donate to the County of Allegheny ten (10) V-Quip Recycling to be used for municipal recycling purposes by Allegheny County; and

                     Whereas, the aforesaid donations can be used by the Allegheny County Department of Health in carrying out its mandated duties under the Local Health Administration Law and other applicable statutes; and 

                     Whereas, Article IV Section 2(j) of the Allegheny County Home Rule Charter vests County's Council with the power and duty by ordinance to accept gifts or donations of personal property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

Section 1.                       Incorporation of the Preamble.

                                          The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

Section 2.                       Authorization of Acceptance of a Donation of Personal Property.

                                          A.                     The County Council of Allegheny County does hereby approve the acceptance of a donation from Crawford County Solid Waste Authority of ten (10) V-Quip Recycling containers to be used for municipal recycling purposes during said containers' useful life; an

                                          B.                     The appropriate County officers and officials are authorized to take such action and execute such documents as are necessary to carry out the purpose of the authorization granted herein.

Section 3.                         Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

Section 4.                       Repealer.  Any Resolution and Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
