An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 07-06, the current schedule of facility and recreational rates and fees for the use of County recreational and park facilities.

Whereas, the County of Allegheny (the "County") owns and operates certain recreational and park facilities; and
Whereas, the County desires to establish and revise rates and fees for the public use of the recreational and park facilities; and
Whereas, Article IV, Sections 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to establish and revise rates and fees for the public use of the recreational and park facilities; and
Whereas, Ordinance No. 07-06 establishes the schedule of rental rates for the County's park facilities, and
Whereas, it is necessary to adjust and/or create certain new rates for certain park facilities.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entity herein.
SECTION 2. Addition of New Subsection to Section 2.O.6.
Section 2.O.6.1 of Ordinance 07-06 is hereby amended to add the following provision:

l. No Rental fee shall be charged or collected for the use of the North Park Flag Retirement Facility, and requests to use this facility shall be granted by the Director of the Parks Department on a first come, first served basis.
SECTION 3. Addition of New Subsection to Section2.S.
Section 2.S. of Ordinance 07-06 is hereby amended to add the following provisions:

2. Ski School Lessons: (One Hour Increments)
a. Private Lesson (Monday-Friday): $20.00
b. Semi-Private Lessons: $20.00
c. Semi-Private Lessons: $13.00 (Each Additional Person)
d. Class or Group Lessons: $10.00
Monday-Friday: 5 pm - 7 pm
Weekends/Holidays: 10 am, 1:30 pm, 5:00 pm, 7:00 pm
e. Group Rate Each Person: $ 5.00 (10 or more people)
3. Ski Equipment Rental:
a. Skis/Boots/Poles: $10.00
b. Snowboard/Boots: $25.00
c. Helmet Rental: $ 5.00
d. Group Rate Each Person: $ 8.00 (10 or more People)
SECTION 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 5. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

NORTH PARK - FLAG RETIREMENT FACILITY

The Department of Parks respectfully requests authorization from County Council to amend Ordinance No. 07-06, the existing schedule of facility and recreational rates and fees for the use of County recreational and park facilities, as follows:
1) To establish fees and oversee the sole operation and management of funds collected by Ski School Lessons and Ski Equipment Rental at the County's Boyce Park Ski Slopes.
2) The County has constructed a flag retirement facility in North Park, which there is no explicit reference in the existing schedule of park fees. No rental fee will be charged for use of the facility and would be determined on a first come, first served basis.
