An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the County Manager to enter into a lease with the Township of McCandless for the use of baseball/softball fields in North Park.

Whereas, the County has leased Lakeview Field in North Park to McCandless for the past several years; and
Whereas, McCandless has held many baseball and softball practices, games and tournaments at Lakeview Field in North Park; and
Whereas, the County and McCandless wish to continue this arrangement under a three year lease; and
Whereas, the County deems it to be in the public interest to grant continued use of this site to McCandless; and
Whereas, by permitting this use, the County enjoys improved public use of parks fields; and
Whereas, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of Preamble
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization of a Lease for the Use of County Real Property
Allegheny County Council hereby authorizes the County Manager to enter into a lease with the Township of McCandless governing the continued use by the Township of McCandless of Lakeview Field in North Park.
Council hereby acknowledges the lease, subject to the terms and conditions as more fully outlined in the written lease.
The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the lease of the property.
SECTION 3. Severability If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 4. Repealer Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
