A Resolution of the County of Allegheny amending the 2009 Capital Budget for Allegheny County.
Body
Whereas, the County has adopted a Capital Budget for the fiscal year beginning
January 1, 2009 and ending December 31, 2009; and
Whereas, at the request of the County's Department of Budget and Finance, County
Council desires to amend the 2009 Capital Budget as set forth in Attachment “A;” and
Whereas, the 2009 Capital Budget will remain in balance if the amendments set forth in Attachment “A” are approved.
The Council of the County of Allegheny hereby resolves as follows:
SECTION 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.
SECTION 2. Approval of Capital Budget Amendment.
The County Council of Allegheny County approves the amendment to the Allegheny County 2009 Capital Budget as set forth in Attachment “A” hereto by increasing the appropriation for the project entitled “Port Authority Capital Matching Funds” by $3,650,779, from $4,625,000 to $8,275,779. Funding for the supplemental appropriation will be provided by County Transit Funds as set forth in Attachment “A”.
SECTION 3. Line Item Detail Amendment.
The line item detail of the appropriations previously approved by Council shall be amended as reflected in Attachment “A” hereto, the provisions of which are incorporated herein by reference.
SECTION 4. Severability.
If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
SECTION 5. Repealer.
Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
SUMMARY OF LEGISLATION
The attached legislation will amend the 2009 Capital Budget by providing additional matching funds for the Port Authority's capital program, exclusive of the North Shore Connector project. The additional local match will provide additional $106 million state and federal funds to the Port Authority. The projects to be funded include an automated fare collection system, light rail system overhaul, and paving of the Martin Luther King, Jr. East Busway. Funding for the supplemental appropriation will be provided by County Transit Funds.
