An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the use of the North Park Golf Course and South Park Golf Course by Bradley Michael, Regional Manager, for the operation of a Million Dollar Hole-In-One Contest Program during 2003 Regular Golf Season.

WHEREAS, the County of Allegheny (hereinafter referred to as “County”) owns and operates certain recreational and park facilities including the parks known as North Park and South Park and the golf courses located therein; and
WHEREAS, the County desires to permit the use of the aforesaid North Park Golf Course and South Park Golf Course by Bradley Michael, Regional Manager, for the purposes of presenting and operating a hole-in-one contest at those locations; and
WHEREAS, Article IV, Sections 2.b. and 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power to permit the use of County land, buildings or other real or personal property.
The Council of the County of Allegheny hereby enacts as follows:
Section 1.
The provisions set forth in the preamble to this Ordinance are incorporated by
reference in their entirety herein.
Section 2.
County Council does hereby authorize the use of the North Park golf course and South Park golf course by Bradley Michael, Regional Manager, for purposes of presenting and operating a hole-in-one contest at those locations. The dates, times and fees for such use shall be as determined by the Allegheny County Parks Department. The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.
Section 3. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall continue, in full force and effect.
Section 4. Any prior Resolutions or Ordinances or part thereof conflicting with the
provisions of this Ordinance are hereby repealed insofar as the same affects this Ordinance.
SUMMARY:
At the tee of a Par 3 that the courses select, they supply an official and a 24” x 24” banner. As the players pass through during their normal round of golf, the official explains the rules of play and informs them what they will receive for their $5.00 fee. The County of Allegheny will receive $.75 for every $5.00 ticket sold and a percentage is also donated to the Diabetes Research Institute. They provide all golf balls, cash prizes and equipment. There is no hard sell or hold up of play. If the golfers shot remains on the putting surface, he/she instantly receives a 3 ball sleeve of Wilson golf balls.
Any golfer who hits a hole-in-one that has paid the $5.00 fee will receive $1,000 cash (within a week) or $500 cash and $500 in gift certificates to the pro shop (within a week). It is the golfers choice on type of payment. Hole-in-one winners will also be invited to participate in the Million Dollar Hole-In-One Tournament held at a 5 Star Resort in Las Vegas to shoot for a Million Dollar Annuity, all expenses paid (excluding transportation).
Million Dollar Hole-In-One will provide a $2,000,000 general Liability Insurance Policy.
