An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending the administrative code of Allegheny county to establish procedures for a voter referendum which proposes an amendment to the Allegheny County Home Rule Charter changing the form of government in accordance with the second class county charter law.

WHEREAS, Section 1101.02 C.4. provides certain procedures for a Voter Referendum which proposes an amendment to the Allegheny County Home Rule Charter; and
WHEREAS, County Council wishes to amend the aforesaid section of the Administrative Code to further provide certain procedures for an amendment of the Home Rule Charter which proposes to change the form of government for Allegheny County to comply with the requirements of the Second Class County Charter Law.
Now, Therefore, the Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by
reference in their entirety herein.
Section 2. Amendment of Section 1101.02 C.4. of the Administrative Code
Section 1101.02 C.4. of the Administrative Code of Allegheny County is amended in part to read as follows:
4. A Voter Referendum which proposes an amendment to the Charter must follow the procedure as set forth in the Home Rule Charter and Optional Plans Law (Act 62)(53 Pa.C.S.A. Section 2901 et seq.) provided however, that a Voter Referendum which proposes a change in the form of government as set forth in the Home Rule Charter may not be submitted to the electors earlier than five (5) years after the date of the election at which the Home Rule Charter was approved by referendum, in accordance with Section 3111-C(c) of the Second Class County Charter Law (Act of July 28, 1953, No. 230 as amended by Act of May 20, 1997, No. 12, Section 3); 16 P.S. Section 6111-C(c).
Section 3. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.
Section 4. Repealer.
Any prior Resolutions or Ordinances or part thereof conflicting with the
provisions of this Ordinance are hereby repealed insofar as the same affects this Ordinance.
