TITLE                                                                                                                                                   

A Resolution of the County of Allegheny establishing the contribution rate for the Allegheny County 9-1-1 System

 

BODY

Whereas, the County of Allegheny has developed a plan and implemented a county-wide 911 emergency communication system (911 system) in accordance with the Pennsylvania Public Safety Emergency Telephone Act (the Act), and

 

Whereas, the Act provides for the assessment of a contribution rate to pay for the nonrecurring and recurring costs of the maintenance and operation of the 911 system, and

 

Whereas, the Allegheny County 911 system and plan includes a contribution rate of $.74 per line, and

 

Whereas, the nonrecurring and recurring costs of the Allegheny County 911 system exceed the amount collected from the current contribution rate, and

 

Whereas, the County, in 2002 and 2003, notified the Pennsylvania Emergency Management Agency (“PEMA”) of the need to increase the contribution rate and of the County's intent to amend the 911 Plan and to hold the necessary public hearing to increase the contribution rate, and

 

Whereas, PEMA acknowledged receipt of County's notice of intent to increase the contribution rate and to hold the necessary public hearing, and

 

Whereas, PEMA has advised the County as to the proper process for increasing the contribution rate and has indicated that a representative of PEMA would attend the required public hearing, and

 

Whereas, the County's 911 Coordinator, in accordance with the Act and the recommendations of PEMA, has taken all necessary steps to amend the 911 Plan and increase the contribution rate, and

 

Whereas, the County's 911 Coordinator has determined that a $1.00 contribution rate is necessary to fund the nonrecurring and recurring costs of the 911 system.

 

The Council of County of Allegheny hereby resolves as follows:

 

Section 1.                     Incorporation of Preamble.

 

                                          The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.

 

Section 2.                     Action to be Taken.                     

                     

                     The County Manager and 911 Coordinator shall take such action as is necessary to modify and increase the 911 contribution rate to $1.00 including the submission of all required information to the Pennsylvania Emergency Management Agency and Public Utility Commission for approval in accordance with the Act and applicable regulations.

 

Section 3.                     Effective Date of Change in Contribution Rate.

 

                     The change in the contribution rate shall take effect immediately upon approval by the Pennsylvania Emergency Management Agency and Public Utility Commission or as otherwise required by the Act.

 

Section 4.                     Severability.                     If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

 

Section 5.                     Repealer.                     Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
