An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing a lease to the Borough of Plum, for a term beginning March 1, 2007 and terminating March 1, 2106, which permits the use of County owned land located in the Borough of Plum, County of Allegheny, Commonwealth of Pennsylvania.

WHEREAS, the County and the Borough of Plum desire to enter into an agreement by and through which the Borough will be permitted to use, or cause to be used, a portion of the County's property lying within Boyce Park for the purpose of constructing a community center and YMCA facility; and
WHEREAS, it has been determined that this use and construction will inure to the benefit of the County's residents, will be performed in a fashion that is in keeping with the existing aesthetics of Boyce Park, and will not interfere with the use of the Park; and
WHEREAS, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County land, buildings or other real property.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. INCORPORATION OF PREAMBLE
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirely herein.
Section 2. AUTHORIZATION OF A LEASE FOR THE USE OF COUNTY REAL PROPERTY
Allegheny County Council hereby approves the lease of approximately 11.5 acres located within Boyce Park, in the borough of Plum and as described in Exhibit A hereto, for the purpose of constructing and operating a community center of approximately 17,500 square feet and YMCA of approximately 35,000 square feet.
Council hereby acknowledges the contract for the period March 1, 2007 through March 1, 2106, subject to the terms and conditions as more fully outlined in the Contract (as attached to this Ordinance as "Exhibit B").
The County acknowledges that only nominal revenues are paid to the County by the Borough, as this program is considered a public service program.
The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the lease of the property.
Section 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
Section 4. Repealer. Any Resolution or Ordinance or part thereof
conflicting with the provisions of this Ordinance is hereby repealed so far
as the same affects this Resolution.
