Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 06-04-OR enacted March 22, 2004 entitled “An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, establishing facility and recreational rates and fees for the use of County recreational and park facilities effective April 1, 2004” by providing that ball field permits and soccer permits for groups under 18 years of age are free of charge.

WHEREAS, the rate for the permitting of a soccer field is $30.00 for a three hour time slot, the same rate as established for ball fields;
WHEREAS, an exception from the permitting fee has been crafted for groups under 18 years of age, but said exception only applies to ball fields;
WHEREAS, the exception to permitting fees has been applied inconsistently for soccer fields, resulting in certain time frames where there is no charge and others where the normal permitting fee applies; and
WHEREAS, in order to ensure consistency and to encourage the use of the County parks by the youth of our County, such exception should be applied uniformly to ball fields as well as soccer fields.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1.
Exhibit A, Page 17, “Ballfields” is amended to read as follows:

Ballfield & Soccer Field Permits for groups under 18 years of age FREE OF CHARGE
Ballfields 30.00/3 hr. time slot
Soccer Fields: 30.00/3 hr. time slot
Lighted Ballfields: 50.00/time slot below

Football Field:
North Park - J.C. Stone Field 150.00/Day
North Park - J.C. Stone Field (Lighted) 300.00/Night
* Any additional cost realized by the County are to be reimbursed by user subject to approval for the 2004 calendar year.
SECTION 2. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 3. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
