An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, Authorizing Use of the Parking Facilities at Hartwood by the United States Golf Association for Parking for the U. S. Open Golf Tournament

Whereas, the County of Allegheny (hereinafter referred to as  “County”) owns and operates certain recreational and park facilities including the park known as Hartwood; and

 

                     Whereas, the County desires to permit the use of parking facilities at Hartwood by the United States Golf Association for parking for the U.S. Open Golf Tournament; and

 

                     Whereas, Article IV, Sections 2.b. and 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power to permit the use of County land, buildings or other real or personal property.

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.  Incorporation of Preamble

 

                     The provisions set forth in the preamble to this Ordinance are incorporated by

reference in their entirety herein.

 

Section 2.  Use of Hartwood Parking Facilities

 

                     County Council does hereby authorize the use of the parking facilities at Hartwood by the United States Golf Association for parking for the U.S. Open Golf Tournament to be held during the week of June 11, 2007.  The days, hours and other conditions of use shall be as determined by the Department of Parks.  There shall be no fee charged for such usage.  The appropriate County officers and officials are authorized to take such action as is necessary to carry out the purposes of the authorization granted herein.

 

Section 3.  Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.

 

 

Section 4.  Repealer.  Any prior Resolutions or Ordinances or part thereof conflicting with the provisions of this Ordinance are hereby repealed insofar as the same affects this Ordinance.

 

 

SUMMARY OF LEGISLATION

 

This legislation would permit the United States Golf Association to use the parking facilities at Hartwood for parking for the U.S. Open without a fee.  The proper County officials would be authorized for take any action necessary to carry out this authorization.
