An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 29-02, approved June 4, 2002, entitled the Homestead and Farmstead Exclusion or Exclusion Program for Homestead and Farmstead Property by providing for a $15,000 homestead and farmstead exclusion.

WHEREAS, County Council adopted Bill No. 0727-02 on June 4, 2002, now Ordinance No. 29-02, establishing a Farmstead Exclusion or Exclusion Program for Farmstead Property within Allegheny County pursuant to Act 50 of 1998, §§8581-87, under which the initial $10,000 in assessed value of each farmstead property within Allegheny County be exempted from property taxation; and
WHEREAS, County Council previously adopted Bill No. 0677-02 on April 2, 2002, now Ordinance No. 12-02, creating and establishing a Homestead Exclusion Program pursuant to Act 50 of 1998, §§8581-87, under which the initial $10,000 in assessed value of each homestead property within Allegheny County be exempted from property taxation; and
WHEREAS, it is County Council's desire to increase the amount of the exclusion offered to Act 50 participants in Allegheny County by $5,000 in order to further offset increased property taxes within the County;
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Amendment of Ordinance No. 29-02
A. Section 2 of Ordinance No. 29-02 shall be amended as follows:
Section 2. Creation of Homestead Exclusion
There is hereby created and established an Act 50 of 1998 Homestead Exclusion for all applicable Allegheny County properties. The initial ten fifteen thousand dollars ($1015,000) of the assessed value of any homestead property in Allegheny County shall be excluded from Allegheny County real property taxation.
B. Section 3 of Ordinance No. 29-02 shall be amended as follows:
Section 3. Creation of Farmstead Exclusion
There is hereby created and established an Act 50 of 1998 Farmstead Exclusion for all applicable Allegheny County properties. The initial ten fifteen thousand dollars ($1015,000) of the assessed value of any farmstead property in Allegheny County shall be excluded from Allegheny County real property taxation. The exclusion for farmstead property shall be in addition to any exclusion for homestead property for which the dwelling on the farm may qualify.
SECTION 2. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 3. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
