An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, granting the County Manager authority to lease certain classroom and kitchen/workshop space at the Police and Fire Academy to the Community College of Allegheny County (CCAC) for CCAC's Food Service Training Program for Special Needs Adults.

                     Whereas, the County of Allegheny owns buildings located at the Police and Fire Academy; and

 

                     Whereas, the County of Allegheny has historically leased facilities in the building to CCAC for its Food Service Training Program; and

 

                     Whereas, the Article IV Section 2 (j) of the Home Rule Charter of Allegheny County requires that use of County buildings be approved by ordinance; and

 

                     Whereas, the County and CCAC desire to continue the lease arrangement in order to provide the said food service program to CCAC's special needs adult students. 

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                       Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

SECTION 2.                       Authorization to Lease County Property to CCAC to provide space at the Police and Fire Academy for CCAC's Food Service Training for Special Needs Adults.

 

                     The County Council of Allegheny County does hereby grant authority to the County Manager to take any and all actions, including but not limited to, the execution of all leases, documents and papers, necessary to continue its lease agreement that provides that the County shall lease to CCAC an office, kitchen/workshop and classroom at the County's Police and Fire Academy located in North Park for CCAC's food service training program, in consideration of the County receiving the sum of $6,871.01 per term, subject to the approval of the County Solicitor.

 

SECTION                     3.                     Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     4.                     Repealer.   Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution. 

 

 

 

SUMMARY PAGE

 

CCAC has leased space from the County at the North Park Police and Fire Academy for CCAC's Food Service Training Program for Special Needs Adults and has leased space from the County at this location since the mid 1970's.  These courses teach food preparation skills to special needs adults.  This legislation would authorize CCAC to continue leasing County-owned real estate in furtherance of this program.
