Whereas, the County of Allegheny is the owner of a 803.634 acre tract of land identified in the Allegheny County Block and Lot system as 648-R-0374 (a portion of which is in White Oak Borough, Allegheny County, Pennsylvania and a portion of which is in North Huntingdon Township, Westmoreland County, Pennsylvania) known and popularly identified as White Oak Park (hereinafter “White Oak Park”); and

Whereas, A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement, is the owner of a tract of land totaling approximately 5.28 acres located in North Huntingdon Township, Westmoreland County, Pennsylvania, that is contiguous to White Oak Park and identified in the Westmoreland County Block and Lot system as 54-06-01-0-007 (hereinafter collectively the “Property”); and

Whereas, A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement, has proposed an exchange of real properties with the County by conveying a portion of the Property containing approximately 0.89 acres of unbuildable vacant land identified as “Tract B” in the proposed Staso-Allegheny County Subdivision Plan incorporated by reference and attached hereto as Exhibit 1 (the Subdivision Plan”) to Allegheny County to be used as part of White Oak Park in exchange for the County’s conveyance of a portion of White Oak Park containing approximately 0.88 acres of unbuildable vacant land identified as “Tract A” in the Subdivision Plan to A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement; and

Whereas, said parcels of land proposed to be exchanged are approximately the same size and are of equal value; and

Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to accept by ordinance grants, gifts and donations of real property on behalf of the County; and

Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter also vests County Council with the power by ordinance to lease, convey, vacate or abandon the use of County land; and


The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization to Convey County Real Property; Authorization to Accept Conveyance of Real Property.

Allegheny County Council hereby authorizes the following actions regarding the exchange of real properties between the County and A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement:

1. County Council hereby authorizes the conveyance of a portion of White Oak Park containing approximately 0.88 acres of unbuildable vacant land identified as “Tract A” in the Subdivision Plan to A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement.

2. County Council hereby authorizes the County’s acceptance of a donation of a portion of the Property containing approximately 0.89 acres of unbuildable vacant land identified as “Tract B” in the Subdivision Plan from A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement, to be used solely and exclusively as part of White Oak Park

B. The above exchange of properties hereby authorized is subject to the express condition precedent that A. Keith Staso, Trustee of the A. Keith Staso Revocable Trust Agreement, shall bear all costs associated with the preparation, review and recording of the Subdivision Plan, preparation of metes and bounds or other legally acceptable descriptions of the exchanged properties, preparation of deeds, title insurance, recording fees and any and all other costs associated with the exchange of Tracts A and B.

C. The proper officers of the County are hereby authorized to execute all documents necessary to effectuate the authorization granted by this Ordinance.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

SECTION 5. Effective Date. This Ordinance shall enter effect immediately upon its approval.
