TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania authorizing the Department of Administrative Services -- Division of Purchasing to conduct an internet auction of two (2) surplus hydraulic cardboard compactors.
BODY
Whereas, the County of Allegheny owns two (2) Marathon Hydraulic Cardboard Compactors that are presently located at the County Jail; and
Whereas, the County has determined that these compactors are surplus property and are no longer needed by the County for any purpose; and
Whereas, Section 5 - 701.05 of the Administrative Code generally provides for the sale or disposition of County property other than real estate either by public or private sale; and
Whereas, the Department of Administrative Services -- Division of Purchasing believes that the most efficient and effective method of disposal of the surplus compactors is by public sale to the highest bidder at an auction using the Internet; and
Whereas, the Allegheny County Administrative Code requires the disposition of County-owned property through an Ordinance passed by County Council.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
SECTION 2. Authorization to Sell Surplus Property at Internet Auction.
A. The Department of Administrative Services -- Division of Purchasing, (hereinafter Purchasing), is hereby authorized to conduct a Public Auction sale using the Internet of the following items of surplus County property:
Two (2) Marathon Hydraulic Cardboard Compactors presently located at the County Jail identified as follows:
1. Model V-2420, County Tag #061472 with Serial #73189.
2. Model #V-2420, County Tag #061473 with Serial #73188.
B. The public auction of the above-named items shall be conducted at such a time and under such terms and conditions as shall be established by Purchasing; provided however, that the minimum bid price for each item shall not be less than $1000.
C. Following the receipt of final bids in an amount greater than the minimum bid price set forth in Paragraph B above, Purchasing is authorized to sell the surplus compactors to the highest bidder.
SECTION 3. Additional Actions Authorized.
Purchasing and the County Manager are hereby authorized to take any other additional actions deemed necessary and prudent to carry out the intentions of the Ordinance.
SECTION 4. Severability. If any provision of the Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.
SECTION 5. Repealer. Any Resolution or Ordinance or any part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
