AN ORDINANCE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Administrative Code of Allegheny County, Article 307, encompassing the Operations of Allegheny County Council, through the creation of a new §5-307.10, entitled "Board Membership on Authorities and Agencies," and providing for the requisite membership of Council Members on such boards.
WHEREAS, the Administrative Code of Allegheny County Council provides for County Authorities and Agencies created by the County for the performance of important governmental functions; and
WHEREAS, the Home Rule Charter requires County Council to adopt laws and approve an annual budget, Council Members need to be in a policy making position within entities making financial decisions and performing important government functions affecting County residents; and
WHEREAS, such membership gives Council a more substantial role justified by our position as elected representatives of the citizens within the various districts of Allegheny County;
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
Section 2. Amendment of the Administrative Code.
The Administrative Code of Allegheny County, Article 307, entitled "Operations of County Council," is hereby amended through the creation of a new §5-307.10, entitled "Board Membership on Authorities and Agencies," and comprised as follows:
§5-307.10. Board Membership on Authorities and Agencies.
A. Membership. At least one member of Council shall serve on the boards of all enumerated County Agencies and Authorities as defined by the Administrative Code Sections 5-203-01 and 5-215-01 as well as the Community College of Allegheny.
Section 5. Severability.
If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
Section 6. Repealer.
Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
