TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, ratifying a contract with FUNDS FOR CHARITIES for the sponsorship of a haunted house in SOUTH PARK known as 100 ACRES MANOR.
BODY
Whereas, the County of Allegheny, Parks Department has a 'haunted house' in South Park for many years where as the proceeds from the benefit of various charities; and
Whereas, FUNDS FOR CHARITIES and the County wished to continue this contract for three seasons beginning July 12, 2004 through December 31, 2006; and
Whereas, the County deems it to be in the public interest to grant continued use of this site to FUNDS FOR CHARITIES, as thousands of park patrons have long enjoyed the haunted house and many have benefited from the charitable contributions; and
Whereas, by permitting this use, the County enjoys improved public relations; and
Whereas, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of Preamble.
The provision set forth in the preamble to this Ordinance are incorporated by reference in their entirely herein.
SECTION 2. Ratification of a Lease for the Use of County Real Property
Allegheny County Council hereby approves the continuation of a contract to FUNDS FOR CHARITIES for the administration of the haunted house at South Park known as 100 ACRES MANOR for the benefit of various charities.
Council hereby ratifies, approves and acknowledges the contract for the period July 12, 2004 through December 31, 2006, subject to the terms and conditions as more fully outlined in the Contract.
The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the lease of the property.
SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
