A Resolution of the County of Allegheny amending Resolution No. 14-05, establishing the contribution rate for the Allegheny County 9-1-1 System.

Whereas, the County of Allegheny has developed a plan and implemented a county-wide 911 emergency communication system (911 system) in accordance with the Pennsylvania Public Safety Emergency Telephone Act (the Act), and
Whereas, the Act provides for the assessment of a contribution rate to pay for the nonrecurring and recurring costs of the maintenance and operation of the 911 system, and
Whereas, the Allegheny County 911 system and plan includes a contribution rate of $.74 per line, and
Whereas, under the terms of the Public Safety Emergency Telephone Act, the approval of County Council is required before a change in the contribution rate may be requested by the County, and such change is not effective until approved by the Pennsylvania Public Utility Commission; and
Whereas, on May 3, 2005, Allegheny County Council passed Resolution 14-05, which approved an increase of the contribution rate to $1.00, and
Whereas, the County's 911 Plan, including the new contribution rate, was forwarded to the Pennsylvania Public Utility Commission for review on September 7, 2005, but has not yet received approval; and
Whereas, the County currently operates a single primary 9-1-1 call center and a single backup center, both of which are located within the City of Pittsburgh; and
Whereas, in the event of a catastrophic event affecting the City of Pittsburgh, the utility of a second backup call center located outside the City would be great; and
Whereas, the Borough of Mount Lebanon already maintains its own state of the art 9-1-1 call center that is easily accessible from the City of Pittsburgh and could be made available to the County, if necessary, should adequate preparations be made;
The Council of County of Allegheny hereby resolves as follows:
Section 1. Incorporation of Preamble.
The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.
Section 2.
Section 3 of Resolution 14-05 is amended as follows:
Section 3. Effective Date of Change in Contribution Rate.
The change in the contribution rate shall take effect immediately upon approval by the Pennsylvania Emergency Management Agency and Public Utility Commission and upon inclusion of the Mount Lebanon 9-1-1 call center as a second backup for the County 9-1-1 call center in the County Plan, or as otherwise required by the Act.
Section 3. Severability. If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.
Section 4. Repealer. Any resolution or ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
