An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the transfer of Ownership of a County Police Horse back to the original donors.

                     Whereas, Section 701.05 (C) of the Administrative Code provides that the County may dispose of any County-owned personal property in a manner approved by the County Manager provided that the personal property has been determined by the County's Controller to have a nominal value; and

 

Whereas, the County is the owner of “Mac”, a County Police horse, that has been used by the County Police Department; and

 

Whereas, the Superintendent of the Police Department has requested that the ownership of the horse be transferred to the original owners who had donated the horse to the County Police approximately five (5) years ago; and

 

                     Whereas, the temperament of the horse is unsuitable for Police work and may create a liability for Allegheny County; and

 

                     Whereas, the Controller of Allegheny County has determined that the Police horse in question has only nominal value; and

 

Whereas, Article IV, Section 2 (k) of the Allegheny County Home Rule Charter provides that County Council may authorize, by ordinance, the conveyance of County-owned real or personal property.

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.  Incorporation of Preamble

 

                     The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

Section 2.  Authorization to Transfer Ownership of Police Horse

 

                     Pursuant to Section 701.05 of the Administrative Code, County Council does hereby authorize and approve the transfer of ownership of the police horse known as “Mac” to the horse's previous owners, James G. and Jeanette A. Bally.

 

Section 3.                     The County Manager or his designee is authorized to take any and all further

action as may be necessary or proper to carry out the purpose of this Ordinance.

 

Section 4.  Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.

 

Section 5.  Repealer.  Any prior Resolutions or Ordinances or part thereof conflicting with the provisions of this Ordinance are hereby repealed insofar as the same affects this Ordinance.

 

 

Summary

 

This Ordinance will authorize the appropriate County officials to transfer the ownership of a County Policy Horse to its original owners.  The County Police Superintendent has determined that this horse is unsuitable for Police work and may create a liability for Allegheny County.  The Controller has determined that the Police horse in question has only nominal value.
