An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, establishing the Department of Institutional Development within the Executive Branch of the County government.

                     WHEREAS, Allegheny County is in need of funding services in addition to taxes and grants in order that it may fulfill its obligation to provide essential governmental services and facilities to its residents; and

 

                     WHEREAS, County Council notes the growing trend among public sector entities such as government owned/affiliated and local municipalities to derive additional funds through fundraising within the private sector and the general public and finds that such efforts may prove to be beneficial to Allegheny County;

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.                     Incorporation of the Preamble.

 

The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

Section 2.                     Establishment of the Department of Institutional Development.

 

Pursuant to the authority vested in County Council pursuant to Article IV, Section 6 of the Allegheny County Home Rule Charter, there is hereby established as a department within the Executive Branch of County government, the Department of Institutional Development. The mission and purpose of this department shall be to raise funds from private sector entities and also from individuals to support such County services, projects and programs as may from time to time be determined.

 

 

Section 3.                     Formation.

 

A.                     Within ninety (90) days of the date of enactment hereof, the Chief Executive shall nominate, for approval by County Council pursuant to Article IV, Section 2(f) of the Home Rule Charter, a Director for the Department. The Director shall report to the Chief Executive and shall serve at the Chief Executive's pleasure.

 

B.                     The initial Director shall, within one hundred twenty (120) days of confirmation, submit to County Council for its approval a business plan for the Department, which will identify the goals and objectives, budget, and personnel requirements for the next three (3) fiscal years.

 

C.                     The business plan referred to in (b) above shall be revised on an annual basis and shall be submitted as part of the comprehensive fiscal plan.

 

Section 4 .                     Severability.

 

If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

Section 5.                     Repealer.

Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
