An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Administrative Code of Allegheny County, Article 705, entitled “Naming Rights,” through the creation of a new §5-705.05, entitled “Adopt A Grove program,” in order to establish a Countywide “Adopt A Grove” program for groves located within the County Parks.

                                          WHEREAS, Allegheny County Council, through Resolution 27-05-RE and the enactment of a comprehensive naming rights ordinance, codified at Article 705 of the Administrative Code of Allegheny County, has established a willingness to create a revenue stream for the County through the sale of naming rights for or within properties owned or administered by Allegheny County; and

 

WHEREAS, it is the judgment of Council that establishing a program through which groves located within the nine County Parks could be “adopted” in exchange for in-kind contributions of volunteer services to the County by County residents and/or corporate or other entities located within the County would establish a mechanism through which volunteer efforts could be tangibly rewarded and encouraged; and

 

WHEREAS, it is further the judgment of Council that such a program would inure to the benefit of the residents and taxpayers of the County;

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

 

SECTION 1.                                          

 

The Administrative Code of Allegheny County, Article 705, entitled “Naming Rights,” is hereby amended through the creation of a new §5-705.05, comprised as follows:

 

§5-705.05.  Adopt A Grove program.

 

Notwithstanding any other provision of this Article, the Director of the County Parks Department  and County Manager may, at their discretion, implement and administer an Adopt A Grove program through which groves in the County Parks would be fitted with signage produced and fitted by the County indicating that such groves have been adopted by an individual or other entity, or in memory of any individual resident(s) of the County, in exchange for financial and/or in-kind contributions of volunteer services to the County by County residents and/or corporate or other entities located within the County.  In the event that a program is implemented pursuant to this Section, the Director of the Parks Department and/or Manager shall provide notice of all signage placed to Council within thirty (30) days of placement. 

 

SECTION 2

 

The County Manager and/or Director of the Parks Department shall notify County Council with a copy of the program guidelines no less than ninety (90) days prior to their implementation.

 

 

SECTION                     3.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
