Title: Ordinance of the County of Allegheny granting authority to demolish certain structures in South Park.

Ordinance of the County of Allegheny granting authority to demolish certain structures in South Park.
 
      Whereas, the County of Allegheny owns five  buildings in South Park identified as (i) Duck Pond House (299 McConkey Road); (ii) McConkey House (S-10 McConkey Road); (iii) McConkey Barn (S-10 McConkey Road); (iv), Schoonamaker (Fair Grounds Complex 2100 Brownsville Road); and (v) Sedota House (S-5 Corrigan Drive), hereinafter collectively referred to as the "South Park Properties"; and
 
      Whereas, Section 5-701.06 of the Allegheny County Administrative Code permits the County to raze or demolish any existing building that may be no longer necessary for the carrying out of any of its functions under terms and conditions prescribed and approved by ordinance; and
 
Whereas, County's Department of Facilities Management in conjunction with the Parks Department  has concluded that due to the deteriorating and unsafe condition of the South Park Properties they cannot continue to carry out their  functions and that they should be demolished.
The Council of the County of Allegheny hereby enacts as follows:
 
Section 1.       Incorporation of the Preamble.
            The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
 
Section 2.      Grant of Authority to Demolish the "South Park Properties".
 
                      Authority is hereby granted to demolish the South Park Properties pursuant to terms and conditions and contracts recommended  by the Department of Facilities Management in conjunction with the County Law Department and approved by the County Manager. The appropriate County officers and officials are authorized to execute all agreements and documents as required to effectuate the demolition of the South Park Properties and take such other action as is necessary to carry out the purpose of the authorization granted herein.
 
Section 3.        Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
 
 
 
Section 4.        Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
