An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 55-03-OR, entitled “An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending the Administrative Code, specifically the Accountability, Conduct & Ethics Code, in order to supplement the provisions governing Standard of Conduct by providing that 'purely personal or political mail' is prohibited,” by providing further direction in defining the term “official mail.”

WHEREAS, County Council adopted Ordinance No. 35-01 on April 3, 2001, establishing the Accountability, Conduct, and Ethics Code; and has made subsequent amendments to the Code including the most recent changes relating to County mail - Ordinance No. 52-03-OR on October 7, 2003 and Ordinance No. 55-03-OR on November 5, 2003; and
WHEREAS, it is the intent of County Council that Ordinances Nos. 52-03-OR and 55-03-OR shall complement each other and provide more guidance to the Accountability, Conduct, and Ethics Commission when addressing possible violations of the Ethics Code's Standard of Conduct, particularly when it relates to the use of County mail.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. AMENDMENT OF ARTICLE 1013, SECTION 1013.09 OF THE ETHICS CODE.
Section 1013.09, Standards of Conduct, Subsection N shall be amended to read as follows:
Section 1013.09 Standards of conduct.
N. Misuse of County resources
(1) No Covered Person shall use, request or permit the use of County resources, including, but not limited to, motor vehicles, equipment, and materials, except for County purposes.
(2) No Covered Person shall use County mail to transmit mail that is personal or political in nature.
i. Official mail is mail which relates to the official duties of all applicable employees of the Government of Allegheny County and which is authorized to be transmitted in the mail through the Department of Administrative Services, or through an outside vendor under contract with the County or County employee.
ii. Official mail and prohibitions thereof shall also include those definitions provided for within Ordinance No. 52-03-OR.
SECTION 2. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 3. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
