An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Ordinance No. 07-06, the existing schedule of facility and recreational rates and fees for the use of County recreational and park facilities.

Whereas, the County of Allegheny (hereinafter referred to as “County”) owns and operates certain recreational and park facilities; and
Whereas, the County desires to establish and revise rates and fees for the public use of the recreational and park facilities; and
Whereas, Article IV, Sections 2.b. and 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power to establish fees and service charges; and
Whereas, Ordinance No. 07-06 establishes the schedule of rental rates for the County's park facilities; and
Whereas, since the enactment of Ordinance 07-06 on March 21, 2006, the County has constructed a flag retirement area in South Park to which there is no explicit reference in the existing schedule of parks fees;
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble
Section 2.O.11 of Ordinance 07-06 is hereby amended as follows:.

s. The Director of the Parks Department may, at his discretion and with the prior approval of Allegheny County Council, promulgate a schedule of long term rental fees for the park's exhibit buildings.
t. No rental fee shall be charged or collected for the use of the By Dawn's Early Light Flag Retirement Plaza, and requests to use this facility shall be granted by the Director of the Parks Department on a first come, first served basis.
SECTION 2. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
SECTION 3. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
