TITLE

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, permitting the use of County property by FUNDS FOR CHARITIES, INC for the sponsorship of a haunted house in SOUTH PARK known as 100 ACRES MANOR.

 

BODY

                     Whereas, The County of Allegheny, Parks Department has a 'haunted house' in South Park for many years where the proceeds benefit various charities.

 

                     Whereas, FUNDS FOR CHARITIES and the County wish to continue this contract for three seasons beginning January 1, 2009 through December 31, 2011.

 

                     Whereas, the County deems it to be in the public interest to grant continued use of this site to FUNDS FOR CHARITIES.  Thousands of park patrons have enjoyed the haunted house and many have benefited from the charitable contributions.

 

                     Whereas, by permitting this use, the County enjoys improved public relations.

 

                     Whereas,  Article IV, Section 2 (k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by Ordinance to lease or permit the use of County real property.

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                     Incorporation of the Preamble

 

                     The provision set forth in the preamble to this Ordinance are incorporated by reference in their entirely herein.

 

SECTION 2.  Authorization of a lease for the use of County Real Property

 

A.                     Allegheny County Council  hereby approves the use of County property by FUNDS FOR CHARITIES INC. for the operation of a haunted house at South Park known as 100 ACRES MANOR for the benefit of various charities.

 

 

B.                     The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the lease of the property.

 

SECTION 3.  Severability.   If any provision of this Ordinance shall be determined to be                      unlawful, invalid, void or unenforceable, then that provision shall be considered                      severable from the remaining provisions of this Ordinance which shall be in full force                      and effect.

 

SECTION 4.      Repealer.   Any Resolution or Ordinance or part thereof conflicting with the                      provisions of the Ordinance is hereby repealed so far as the same affects this                      Resolution.

The Department Parks respectfully requests authorization for the continuing use of property located on 100 Acres Road in South Park for a non-profit organization to operate a Haunted House.

 

This term of this agreement will begin January 1, 2009 and continue through December 31, 2011, with Estimated Revenue of $66,000.00.
