An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Article 1013 of the Administrative Code, the Accountability, Conduct and Ethics Code of Allegheny County, by providing a new subsection in § 1013.09 prohibiting covered persons from soliciting while in uniform or when carrying a firearm, concealed or otherwise.

                                          WHEREAS, the Allegheny County Administrative Code establishes an Accountability, Conduct and Ethics Code to set a tone and environment for the County that reflects a standard of conduct that is in the public interest and in opposition to personal interests and gains; and

 

                                          WHEREAS, at all times, behavior of employees and officials of the County should be above reproach and foster increased public trust in County government, and government as a whole; and

 

                                          WHEREAS, solicitation of gifts, loans, rewards, promises of future employment, benefits, or considerations is already prohibited under specific circumstances outlined within the Administrative Code, yet no restriction is in place for such solicitation while in uniform or carrying a firearm, concealed or otherwise.

 

                                          WHEREAS, in order to insure that the conduct of employees and that the public trust is fostered, there must be no impression of impropriety or misconduct made through solicitation while in uniform or when carrying a firearm, concealed or otherwise.

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.

 

Article 1013, § 1013.09 (E) is amended by adding a new subsection (2) as follows:

 

1013.09.                     Standards of conduct.

 

E.                     Gifts, loans, benefits, and considerations; accepting improper influence.

 

(1)                     No covered person shall solicit, directly or indirectly, a gift, loan, reward, promise of future employment, benefit or consideration from:

 

a)                     A person or business having a financial relationship with the County;

 

b)                     A person or business whose operations or activities are regulated or inspected by the County;

 

c)                     A principal and/or attorney in proceedings in which the County is an adverse party; or

 

d)                     Any person or business where the performance or nonperformance of any official duty may be influenced or affected.

 

(2)                     No covered person shall solicit, directly or indirectly, a gift, loan, reward, benefit, consideration, or anything of value to the office in which he or she is employed while in uniform or while carrying a firearm, concealed or otherwise.

 

SECTION                     2.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     3.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
