TITLE

An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the ratification and execution of a lease of County owned real property with Dennis and Mary Beth Cillo, including the operation and management of the South Park Pony Ring on Corrigan Drive, South Park Township, Allegheny County, Pennsylvania.

 

BODY

Whereas, the County of Allegheny Parks Department advertised for the continued management and operation of a pony ring in South Park, utilizing an existing pony ring; and   

 

Whereas, the award of this contract was for a period from May 3015, 2003 through December 30, 2006, with the possibility of being extended until May 1, 2008 pending the construction of a small stable on the property by the concessionaire; and

 

Whereas, the County deems it to be in the public interest to grant continued use of this site to Dennis and Mary Beth Cillo because the park patrons have long enjoyed pony rides and  the Cillos have expanded the use by offering carriage rides; and

 

Whereas, by permitting this use, the County enjoys increased revenues from this service and property improvements by the concessionaire; and

 

Whereas, Article IV, Section 2(k) of the Allegheny County Home rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

 

SECTION 1.  Incorporation of Preamble.

 

                     The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

 

 

 

 

Section 2 Authorization of a Lease of County Real Property.

 

The County hereby authorizes the ratification and execution and extension of a lease with Dennis and Mary Beth Cillo for their use, operation and management of the pony ring located on Corrigan Drive, South Park Township, Allegheny County, Pennsylvania. 

 

 

SECTION 3.  Acknowledgement and Ratification of Lease of County Real Property.

 

The County hereby acknowledges and ratifies the lease, contemplated by this Ordinance, for the period May 3015, 2003 through December 30, 2006., with the possibility of the extension of the lease through May 1, 2008, pending the construction of a small table on the site, subject to the terms and conditions as more fully set forth in the lease agreement.

 

SECTION 4.  Additional Authority.

 

The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the consummation of the lease contemplated by this Ordinance.

 

 

 

Section 5.                     Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered

severable from the remaining provisions of this Ordinance which shall be in

full force and effect.

 

 

Section 6.                     Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.
