TITLE
An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the transfer of Ownership of certain historic artifacts associated with President Abraham Lincoln.
BODY
Whereas, the County Administrative Code provides for disposal of County owned personal property; and
Whereas, the County is in the owner of certain artifacts associated with President Abraham Lincoln; and
Whereas, the Director of the County Parks Department has provided conservation of said artifacts by agreement with the Senator John Heinz Pittsburgh Regional History Center; and
Whereas, the Senator John Heinz Pittsburgh Regional History Center is the official repository of Allegheny County artifacts; and
Whereas, the Senator John Heinz Pittsburgh Regional History Center has the personnel and facilities to permanently maintain and conserve the said artifacts; and place said artifacts on exhibit for enjoyment by all citizens of Allegheny County and
Whereas, Article IV, Section 2 (k) of the Allegheny County Home Rule Charter provides that County Council may authorize, by ordinance, the conveyance of County-owned real or personal property.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of Preamble
The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.
Section 2. Authorization to Transfer Possession and Ownership of President
Abraham Lincoln Artifacts
Pursuant to the Administrative Code, County Council does hereby authorize and approve the transfer of ownership of certain historical artifacts namely:
a. (3) Blue Prints;
b. Bible;
c Chair: Rocking - cut out back - like #15
d. Bureau: Wardrobe (7) pieces;
e. Chair - commode/or storage
f. Commode with pot and lid;
g. Chair - back and seat feather - tops carved heads
h. Bed - 22 pieces
i. 1 Bundle of 8 slats;
ii. 1 Bundle of 3 boards;
iii. 3 Wide, thin boards;
iv. 2 Carved posts
v. 1 Foot board
vi. 2 Side boards
vii. 1 Back of headboard
viii. 1 Top of headboard - arched top
ix. 1 Rectangular Board
i. Chair - carvings at tops - leather back and front good;
j. Dresser 1 - Bottom (drawer side packed separately) mirror;
k. Dresser 2 - bottom/mirror/loose tray;
l. Short Chair - Rounded top; upholstery;
m. Small table - broken leg - piece with it - oval top - no marble;
n. Chair - (some old velvet) back and seat;
o. Chair - Rocking -- seat bad;
p. Samples: Feathers (attic) / Patterned fabric / burlap / Orange fabric / attic;
q. Fabric (textiles) - (2) - scarves;
r. Table - Demi-lunc;
s. Curtain Rods (2) -with rings - One end missing - frail;
t. Marble Tops (4) pieces - (1) curved for Dresser;
u. Box springs.

Section 3. Restrictions on Subsequent Transfer, Possession or Ownership
The Senator John Heinz Pittsburgh Regional History Center may not sell or otherwise transfer ownership of the items listed in section 2 above, or any of them, without first obtaining prior written consent from Allegheny County, via legislative action as prescribed by the Home Rule Charter and Administrative Code. If the Senator John Heinz Pittsburgh Regional History Center attempts to sell or otherwise transfer ownership of the items listed in section 2 above, or any of them, without obtaining the consent required herein, ownership of all of the items listed in section 2 above shall immediately and automatically revert to Allegheny County without Allegheny County having to exercise any legal process to retain ownership of said items.
Section 4. The County Manager or his designee is authorized to take any and all further
action as may be necessary or proper to carry out the purpose of this Ordinance.
Section 5. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall continue in full force and effect.
Section 6. Repealer. Any prior Resolutions or Ordinances or part thereof conflicting with the provisions of this Ordinance are hereby repealed insofar as the same affects this Ordinance.
