An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending the Administrative Code of Allegheny County, Article 905, entitled "Nonformal Procurement," §5-905.03, entitled "Procurement of professional services," in order to clarify the role of the Allegheny County Professional Services Review Committee and the process by which its members are appointed.

Whereas, the Administrative Code of Allegheny County, §5-905.03, provides for the review of certain contracts for professional services by the Allegheny County Professional Services Review Committee; and  
 
      Whereas, the provisions of §5-905.03 also limit themselves to the following five types of professional services contracts to be reviewed by the Committee:  architectural services, engineering services, financial consulting services, legal services, and medical consulting services; and
 
      Whereas, since the establishment of the Professional Services Review Committee, the committee has provided both invaluable insight and a level of transparency regarding the County's professional services contracts in the five designated subject areas; and   
 
      Whereas, it is the desire of Council to remove the limitation on the Committee's review to only the five delineated professional services contract categories and to refine the mechanism by which the members of the Committee are appointed;
 
The Council of the County of Allegheny hereby enacts as follows:
 
Section 1.      Incorporation of Preamble.
 
The provisions set forth in the Preamble to this Ordinance are incorporated by reference in their entirely herein as findings of fact made by Council.
 
 
 
Section 2.      Amendment of the Code.
 
The Administrative Code of Allegheny County, Article 905, entitled "Nonformal Procurement," §5-905.03, entitled "Procurement of professional services," is hereby amended as follows:
 
§5-905.03.  Procurement of professional services.
 
A.      To review and evaluate proposals received for professional services there is hereby created a Professional Services Review Committee. The Committee will review and evaluate proposals for professional services, including, but not limited to, contracts for the following services or with the following professionals: for
 
1.      Aarchitects, and/or any individuals designing, constructing, or providing consulting services related to building improvements or new construction with an aggregate value of $10,000 or more;
 
2.      Eengineers,;
 
3.      Ffinancial consultants, including any financial institution(s) at which $100,000 or more in County funds will be deposited,;
 
4.      Llegal services, including solicitors and outside counsel,;
 
5.      Mmedical consulting, including diet and nutritional services to be provided to County employees, or diet, nutritional services, or medical services to be provided to individuals housed at any juvenile or adult correctional facility maintained by the County, and;
 
6.      Any individual or other entity conducting feasibility studies, performance reviews, or analyses of any County department, agency delineated within §5-215.01 of the Administrative Code of Allegheny County, or authority delineated within §5-203.01 of the Administrative Code of Allegheny County, on behalf of or pursuant to the request of the Chief Executive or County Manager.  
 
B.      The Committee shall be comprised of five members: the County Executive or his designee, the County Manager or his designee, two three members appointed nominated by the President of Council and approved by a majority of the seated Members of Council, and one appointed  nominated by the Chief Executive with the consent of and approved by a majority of the seated Members of Council. An additional member will be designated by the County Official and/or the President Judge of the Court of Common Pleas, if the professional service contract being acted upon was requested by the respective office or the Court.  The members shall choose a chair from amongst themselves by simple majority vote at the first meeting of each calendar year.
 
BC.      In addition to compliance with any other terms, conditions and requirements set forth in a request for proposals, the Committee shall consider the following criteria:
 
(1)      Summary of costs;
 
(2)      Experience record;
 
(3)      Technical expertise;
 
(4)      Resources and capabilities;
 
(5)      Organization and management plan;
 
(6)      Disadvantaged business enterprise utilization; and
 
(7)      Such other criteria as the Committee shall deem prudent.
 
CD.      After review and evaluation the Committee shall provide an agreed upon short list of at least three acceptable individuals or firms to either the County Executive, County Official, President Judge, or Council, for final selection. If there are three or less proposals received, all shall be submitted. The office which makes the final selection shall notify the Committee and County Council of the final selection.
 
 
 
Section 3.      Short Title.  
 
This Ordinance shall be known as the Mary Walker ordinance.
 
 
Section 4.      Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
 
Section 5.      Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
