Title

An Ordinance authorizing the conveyance of  the County of Allegheny's interest in the parcel known as Block 422-L Lot # 204 (“the Property”) located in the Township of Aleppo, County of Allegheny, Commonwealth of Pennsylvania to the Township of Aleppo.

 

Body

                     Whereas, the Township of Aleppo desires to utilize the Property in its plans for a community recreation park that would benefit the residents of the community; and

 

                     Whereas, the Allegheny County Parks Department has worked extensively with the Township of Aleppo to convert the Property and an adjoining parcel into a community recreation park;

 

                     Whereas, The Township of Aleppo lacks a recreation park facility and the Township has been trending demographically towards younger families who would benefit from a community recreation park; and

 

                     Whereas, the Quaker Valley School District previously approved the conveyance of its interest in the Property to the Township of Aleppo; and

 

Whereas, Article IV section 2(k) of the Home Rule Charter of Allegheny County vests County Council with the power and duty by ordinance to convey real property owned by the County of Allegheny.

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.                      Incorporation of the Preamble.

                     The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

Section 2.                                                               

 

                     A. The County Council of Allegheny County hereby does approve the transfer of the interest held therein by the County of Allegheny in the parcel known as Block 422-L Lot # 204 to the Township of Aleppo for public use as a community recreation park.

                     B. The proper officers of the County of Allegheny are hereby authorized to execute any and all documents, including a deed, necessary to effectuate the conveyance of the County's interest in the Parcel.

 

Section 3.                     Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

Section 4.                       Repealer.  Any resolution or ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

 

SUMMARY OF LEGISLATION

 

The subject parcel is owned by the three taxing bodies:  Township of Aleppo, Quaker Valley School District and the County of Allegheny.  The Township would like to utilize this parcel in its plans for a community recreation area and has approached the other taxing bodies for approval.  Quaker Valley has conveyed its interest to the Township.  The Administration requests that Council approve the conveyance of County's interest in Block and Lot 422-L-204 to the Township of Aleppo.

 

Rationale:  The Allegheny County Department of Parks has been working with Aleppo Township to convert two adjoining parcels into a community park.  One parcel is owned by the Township, the other is the subject property.  Aleppo Township has no parks and has been demographically trending toward younger families.  The Quaker Valley School District also supports the proposal.
