TITLE

An Ordinance authorizing the County of Allegheny to acquire right-of-way for widening Browns Hill Road, developing Parkview Boulevard and relocating Old Browns Hill Road, and conveying any portions thereof for Parkview Boulevard and Old Browns Hill Road to the City of Pittsburgh.

 

BODY

                     Whereas, Allegheny County is responsible for maintaining Browns Hill Road (County Road No. 3047-01 for the upper portion and 3047-02 for the portion approaching the Homestead Grays Bridge, formerly Pittsburgh-Homestead High-Level Bridge, MA12) within the 15th Ward of the City of Pittsburgh; and 

 

Whereas, the Urban Redevelopment Authority of Pittsburgh is sponsoring a project with land developers to improve access to the new Summerset Development, located on the former slag dump below the Squirrel Hill section of the City of Pittsburgh, by developing Parkview Boulevard, a new road, and relocating Old Browns Hill Road at its intersection with Browns Hill Road, to intersect with Parkview Boulevard; and

 

Whereas, the County Council of Allegheny County deems it advisable to acquire, without cost, right-of-way required to develop the entrance for Parkview Boulevard, relocate Old Browns Hill Road and widen the intersection approaches of Browns Hill Road, and to convey any portion of property acquired for Parkview Boulevard and relocated Old Browns Hill Road to the City of Pittsburgh, which is depicted on the drawing that is attached hereto as Exhibit “A” and incorporated herein by reference (the “Property”); and

 

                     Whereas, in accordance with Section 701.02 E of the County Administrative Code, the County Manager has authorized clearing the right-of-way for this project by Executive Action No. 5891-08 dated June 3, 2008.

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

Section 1.                      Incorporation of the Preamble.

                                          The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

Section 2.                     Authorization to Acquire Required Right-of-Way.

 

                                          Council hereby authorizes the acquisition, for One Dollar ($1.00) and other valuable consideration, right-of-way and easements required to widen Browns Hill Road at its approaches to its intersection with Old Browns Hill Road, and to develop a portion of Parkview Boulevard, a new road, and realign Old Browns Hill Road to intersect with Parkview Boulevard in the 15th Ward of the City of Pittsburgh. 

 

Section 3.                     Authorization to Convey Right-of-Way Acquired for Parkview

                                          Boulevard and Relocated Browns Hill Road to the City of Pittsburgh.

 

                                          Council further grants authority for the County to convey to the City of Pittsburgh, or its designee, for consideration of One Dollar ($1.00) and other valuable consideration, any portion of the right-of-way acquired for Parkview Boulevard and relocated Old Browns Hill Road.  The Director of Public Works, or his designee, is authorized to execute in the name of the County such instruments of conveyance and other documents, including subdivision plan that may be necessary to accomplish the conveyance and transfer of the Right-of-Way.

 

Section 4.                      Severability.  If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

Section 5.                     Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

 

 

 

 

SUMMARY OF LEGISLATION

 

                     This Ordinance will authorize the County to accept right-of-way by donation from adjacent land owners to develop an improved access to the new Summerset Development, located on the former slag dump below the Squirrel Hill section of Pittsburgh.  It will also authorize the County to convey any portions of right-of-way acquired for the development of a new road, called Parkview Boulevard, and the relocation of Old Browns Hill Road to intersect with Parkview Boulevard, to the City of Pittsburgh.

 

                     The Urban Redevelopment Authority of Pittsburgh and the adjacent landowners are sponsoring this project.  The County intends to construct this project by contractor, and be reimbursed 100 percent by federal and local match funding from outside sources.  No County funds are involved.
