An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing use of the County's Lakeview Field in North Park by the Town of McCandless for the sponsorship of baseball/softball practices, games and tournaments.

Whereas, the County has authorized use of Lakeview Field in North Park to be used by the Town of McCandless for the past several years; and
Whereas, the County will authorize an extension of time to Contract #39622, effective November 1, 2007 through October 31, 2010; and
Whereas, the Article IV, Sections 2.k. of the Allegheny County Home Rule Charter vests the County's Council with the power and duty by ordinance to permit the use of County land, buildings or other real or personal property owned by the County.
The Council of the County of Allegheny hereby enacts as follows:
Section 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
Section 2. Authorization of a lease for the use of County Real Property.
County Council does hereby authorize the Allegheny County Parks Department on behalf of Allegheny County for an extension of time beginning November 1, 2007 through October 31, 2010 with the Town of McCandless for use of the Lakeview Field in North Park.
Section 3. The County Manager or his designee is authorized to take any and all further action necessary or proper to carry out the purpose of this Ordinance.
Section 4. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
Section 5. Repealer. Any Resolutions or Ordinances or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

The Department of Parks respectfully requests authorization for the continuing use of property located in the County's North Park by the Town of McCandless for softball/baseball practices, games and tournaments.
The time of extension to Contract #39622 for field usage will take effect November 1, 2007 through October 31, 2010.
