Title: Motion to amend Article IV of the Rules of Council for Allegheny County Council through the creation of a new subsection (b.) of Section A.7, “Appointments”, in order to restrict membership to more than two boards of the Authorities or Agencies as enumerated within the Code so as to prevent conflicts and ensure the adequate attention to the boards for which members are appointed.

Amending Article IV of the Rules of Council for Allegheny County Council through the creation of a new subsection (b.) of Section A.7, "Appointments", in order to restrict membership to more than two boards of the Authorities or Agencies as enumerated within the Code so as to prevent conflicts and ensure the adequate attention to the boards for which members are appointed.
 
WHEREAS, the Rules of Allegheny County Council, as currently drafted, make no restrictions on the number of boards which appointees may serve, see Article IV, Rule A.7.; and
 
WHEREAS, it is interest of Council to provide for efficient and effective boards which exist to make recommendations and conduct vital business of the County; and
 
WHEREAS, persons serving multiple appointments to boards of County Authorities or Agencies may find themselves in conflicts of time and interest through their duties of service to a multitude of boards; and
 
WHEREAS,  as Council has the authority to receive recommendations for appointments to Boards, Authorities and Commissions and other units of County Government made by the Chief Executive, it is the Council's duty to vet those appointments appropriately; and
 
WHEREAS, it is the desire of Council to restrict membership to no more than two County Authorities or Agencies as enumerated in the Code, so as to prevent any such conflict;
 
NOW THEREFORE, IT IS MOVED, BY THE COUNCIL OF ALLEGHENY COUNTY,
 
That this Council hereby amends the Rules of Council as follows:

7. Appointments- Council shall receive recommendations for appointments to Boards,
Authorities, Comissions, and other units of County government made by the Chief
Executive at a regularly scheduled meeting of Council. Recommendations shall be
submitted to the Clerk in letter form, addressed to all  members of Council, and shall
contain no more than one name. The letter shall include the name, address, and phone
number of the candidate, the term of office, for which the candidate is recommended,
and the name of the person the candidate will replace. Upon presentation of the
appointment, the legislation will be referred to the appropriate committee for
deliberation where all candidates will be interviewed, and the committee shall make a
subsequent recommendation to the full Council. Council must, by motion, act to confirm
or reject appointments within forty-five (45) days or the appointment shall be effective
as though Council had confirmed it.
 
a.      Beginning February 1, 2008, to the extent that Council appoints at least one member of the Allegheny County Retirement Board under the terms of Section 5-1017.01 of the Administrative Code of Allegheny County or the applicable statute, Council's Budget Director shall be appointed to the Board by Council.
 
b.      Council shall not appoint nor approve a proposed appointee whose appointment would result in a person contemporaneously serving on more than two Authorities, or Agencies defined by Administrative Code Sections 5-203-01 and 5-215-01.
