Resolution of the County of Allegheny, Commonwealth of Pennsylvania, providing that ten percent (10%) of the yearly allocation for Community Development Block Grant (CDBG) Projects, beginning with Year 31, shall be designated in equal shares for distribution by the Chief Executive and County Council, provided that such distribution is in compliance with the provisions of the Housing & Community Development Act of 1974 and its related regulations.

                     WHEREAS, the Housing and Community Development Act of 1974 was enacted to address the critical social, economic, and environmental problems facing the Nation's urban communities and has enabled such assistance through the implementation of the Community Development Block Grant (CDBG) Program; and

 

                     WHEREAS, Allegheny County has participated in the CDBG Program since its inception, providing for its administration through the Allegheny County Department of Economic Development which provides millions of dollars to local governments, nonprofits, community development corporations, and for profit developers; and

 

                     WHEREAS, Allegheny County Council would like to supplement the traditional application process by providing that a particular designation be disbursed by its members and the Chief Executive because of their interaction with the general public and knowledge of issues and concerns in the community that may not be addressed through the traditional application process.

 

The Council of the County of Allegheny hereby resolves as follows:

 

SECTION 1.

 

Beginning with Community Development Block Grant (CDBG) Year 31, ten percent (10%) of the yearly allocation for CDBG Projects shall be designated in equal shares for distribution by the Chief Executive and County Council.  The Chief Executive shall distribute five percent (5%) and the County Council shall distribute five percent (5%).

 

SECTION 2.

 

Such distribution shall be in compliance with the provisions of the Housing & Community Development Act of 1974 and its related regulations.  Administration of the projects and dollars will be retained by the Allegheny County Department of Economic Development which shall assure that disbursements by the County Council and Chief Executive meet the minimum requirements of the CDBG Program.

 

SECTION 3.

 

Determinations regarding how disbursement of County Council's five percent (5%) shall be made by the County Council in a manner its members deem appropriate.

 

SECTION                     4.                     If any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

 

SECTION                     5.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
