Ordinance of the County of Allegheny, Commonwealth of Pennsylvania directing that a referendum question amending Article III, Section 3 and Article V Section 2(g) of the Allegheny County Home Rule Charter and adding Sections 4, 5 and 6 to Article V thereof, pursuant to the Home Rule Charter and Optional Plans Law, be placed on the May 20, 2003 Municipal Primary ballot.

The Council of the County of Allegheny hereby enacts as follows:
Section 1.
Allegheny County Board of Elections is directed to place the following question on the May 20, 2003 Municipal Primary Ballot:
Shall Allegheny County’s Home Rule Charter be amended to a): replace the elected Clerk of Courts, Jury Commissioners (2), Prothonotary, Register of Wills with a Clerk of Records appointed by the Chief Executive and confirmed by County Council and b) replace the elected Coroner, Recorder of Deeds, and Treasurer with a Medical Examiner, Deed Clerk, and Treasurer respectively, appointed by the Chief Executive and confirmed by County Council?
Section 2.
Upon approval of the above question, Allegheny County’s Home Rule Charter shall be amended to read as follows:
Article III, Section 3 - The elected officers of the County shall be 15 County Council Members, the Chief Executive, District Attorney, Controller and Sheriff. The offices and positions of the independently elected Clerk of Courts, Jury Commissioners (2), Prothonotary and Register of Wills are hereby abolished upon the appointment of the Clerk of Records. The office and position of the independently elected Coroner is hereby abolished upon the appointment of the Medical Examiner. The office and position of the independently elected elected Recorder of Deeds is hereby abolished upon the appointment of the Deed Clerk. The office and position of the independently elected Treasurer is abolished upon the appointment of the Treasurer.
Article V, Section 2(g) - Appoint the Manager, the County Solicitor, Medical Examiner, Deed Clerk, Clerk of Records, and Treasurer, with the consent of Council.
Article V, Section 4 - Medical Examiner
The Medical Examiner shall be a licensed physician and shall perform those duties and functions formerly exercised by the Office of the Coroner. The Medical Examiner shall serve as the director of the Medical Examiner’s Department.
Article V, Section 5 - Clerk of Records
The Clerk of Records shall perform those duties and functions formerly exercised by the Offices of Clerk of Courts, Jury Commissioners, and Register of Wills. The Clerk of Records shall serve as the director of the Clerk of Records Department.
Article V, Section 6 - Deed Clerk
The Deed Clerk shall perform those duties and functions formerly exercised by the Office of Recorder of Deeds. The Deed Clerk shall serve as the director of the Department of Deeds.
Article V, Section 7 - Treasurer
The Treasurer shall perform those duties and functions formerly exercised by the Office of Treasurer. The Treasurer shall serve as the director of the Treasury Department.
SECTION 3. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.
SECTION 4. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
