An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, setting forth County policy regarding the sale of naming rights for the Greater Pittsburgh International Airport.

                                          WHEREAS, Allegheny County Council, through Resolution 27-05-RE, has established a desire to create a revenue stream for the County through the sale of naming rights for or within properties owned or administered by Allegheny County; and

 

WHEREAS, to make Greater Pittsburgh International Airport more competitive with other airports in the region it is desirable for Allegheny County to pursue the naming rights for Greater Pittsburgh International Airport in order to lower operating costs through this additional revenue stream; and

 

WHEREAS, the Greater Pittsburgh International Airport is perhaps the largest and most internationally visible asset within the County for which the sale of naming rights is practicable; and

 

                                          WHEREAS, naming rights for sports facilities such as Reliant Stadium in Texas have generated $300 million dollars over 32 years, it is highly desirable that this County pursue this additional revenue stream for Greater Pittsburgh International Airport which does not just have regional, but international name recognition for advertising purposes; and

                                          

WHEREAS, Greater Pittsburgh International Airport, which is administered by the Allegheny County Airport Authority, has experienced significant budgetary pressures from time to time in the past due to decreases in travel and/or decisions by air carriers with regard to the level of service to be offered from the airport; and

 

                                          WHEREAS, the federal government, through the Federal Aviation Administration provides significant grant and other funding each year to the airport; and

 

WHEREAS, the funding conditions established by the Federal Aviation Administration dictate that any revenue raised through the sale of naming rights for airports, including Greater Pittsburgh International Airport, must be allocated to the budget of the entity administering the airport.

 

 

 

 

 

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.                                          

 

The Allegheny County Chief Executive shall retain the services of an individual or company with significant experience in the marketing of naming rights for large assets not otherwise already employed in any capacity by any County agency, authority, board, or other entity to aggressively pursue the sale of naming rights for the Greater Pittsburgh International Airport.  The gross fee for such naming rights shall be negotiated at no less than $5 million per year after such gross fee is indexed to the consumer price index, and shall be for a period of no less than ten years. 

 

SECTION 2.

 

Beginning in March of 2006, the Chief Executive or his designee shall issue a written report to Council no later than the last day of each month fully describing the status of the negotiation process.

 

SECTION                     3.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
