An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania directing that a referendum question amending Article III, Section 3 and Article V Section 2(g) of the Allegheny County Home Rule Charter by adding Section 4 and 5 to Article V thereof, pursuant to the Home Rule Charter and Optional Plans Law, be placed on the 2005 General Election ballot.

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.

 

The Allegheny County Board of Elections is directed to place the following question on the 2005 General Election Ballot:

 

Shall Allegheny County's Home Rule Charter be amended to replace the elected Treasurer and Sheriff with an appointed Treasurer and Sheriff nominated by the Chief Executive and confirmed by County Council?

 

SECTION 2.

 

Upon approval of the above question, Allegheny County's Home Rule Charter shall be amended to read as follows:

 

A.                     Article III, Section 3 - The elected officers of the County shall be 15 County Council Members, the Chief Executive, District Attorney, and Controller.  The office and position of the independently-elected Treasurer and Sheriff shall be abolished upon the confirmation of the appointed Treasurer and Sheriff.

 

B.                     Article V, Section 2(g) - Appoint the Manager, the County Solicitor, Treasurer, and Sheriff with the consent of Council.

 

C.                     Article V, Section 4 - Treasurer. 

 

The Treasurer shall perform those duties and functions formerly exercised by the Office of Treasurer.

 

D.                     Article V, Section 7 - Sheriff.

 

The Sheriff shall perform those duties and functions formerly exercised by the Office of Sheriff. 

 

SECTION                     3.                     If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION                     4.                     Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
